What's the Issue?

I am not entirely sure what my responsibilites are and what is required for me to comply with my duties as an employer or someone who is in control of a premises?

I am not sure if I meet the requirements of a competent person who can undertake a Legionella Water Hygiene Risk Assessment on my premises.

I am after some further guidance and advice on how I can meet my current obligations and responsibilities.

What is your obligation?

As an employer or someone who is in control of a premises, including landlords, it is your responsibility to take the correct precautions to reduce the risk of exposure to Legionella to others. It is a legal requirement under the Health and Safety at Work etc. Act 1974 and the employer or person who controls the premises must appoint someone competent to help you meet your health & safety obligations & responsibilities.

Risks

If appropriate measures are not put into place, then this can result to an exposed risk of litigation & potential prosecution as well as a major health & safety hazard to others. This could then result in a detrimental effect to your company’s reputation and financial standing.

The current fines being imposed for non-compliance can amount to as much as £20,000 and could also result in a criminal record.

For those in control of a premises, including landlords, or if you are an employer then it is your responsibility to ensure that a Legionella Water Hygiene Risk Assessment is in place to prevent exposure to the bacteria, Legionella pneumophilia.

According to the HSE ACoP L8 ‘The Control of Legionella Bacteria in Water Systems’ a Legionella Water Hygiene Risk Assessment should be reviewed every 2 years.

As an employer, or person in control of the premises, it is your responsibility to ensure the health and safety of others and your employees by undertaking the right precautions to reduce the risk of exposure to Legionella. The Water Hygiene Risk Assessment should be undertaken by a competent person who must be able to establish the following: –

  • Identify and assess the sources of risk
  • Manage any risks
  • Prevent or control any risks
  • Keep and maintain the correct records
  • Carry out any other duties you may have

Each building varies in terms of the various water systems that they may hold that supply hot and cold water services. These may also vary in size, scale and complexity; however, all can present a possible risk to the exposure of Legionella. Each assessment may vary; however, it is important to identify where you may need to look at certain risks in more detail and establish particular control measures to prevent any further risks to the building and others.

  • Full written Legionella Risk Assessment report of the entire water system(s)
  • Accurate schematic drawings of the entire plant and water system(s).
  • Full photographic evidence
  • Full written recommendations of any remedial works required to the system(s)
  • Full written recommendations of a Legionella management regime
  • Full written assessment of the current management structure with any further recommendations for training required.
  • Full written assessment of the premises and associated water systems, highlighting all the low & high risk areas identified.
  • Full certification and associated documentation to evidence works undertaken.
  • All assessments undertaken by qualified, competent & experienced ATOM personnel.
